WINCHESTER — A preliminary hearing for entering a plea or setting a trial date for a Martinsburg, West Virginia man charged with attempted first-degree murder and shooting at a motor vehicle was postponed on Friday in Frederick County Circuit Court.

Ellis Fennel, 28, is accused of shooting at a woman’s car three or four times on the 313A on-ramp northbound to Interstate 81 after an argument over possession of her cell phone on July 24, 2016, the criminal complaint says. He has also been charged with using a firearm in commission of a felony.

His original bond appeal was denied in August, and he had been held in Northwest Regional Adult Detention Center. He has been out on bond since December 5.

Fennel’s next court date is scheduled for June 22. The defense gave no indication if there are currently any discussions on a plea agreement.
